General terms and conditions of sale
1. Scope of application
1.1 This website www.kulo.ch is represented by the company CACHALOT Atelier SNC. These general conditions of sale are applicable to product orders placed by mail, mobile or internet with CACHALOT Atelier SNC since April 01, 2022. By placing an order with CACHALOT Atelier SNC, the buyer accepts the application of these General Conditions.
2. Control
2.1 Each item is designed and handmade by Camille Pasquier and Charlotte Pasquier.
2.2 Each product is unique, even if it comes from the same model. Indeed, during production, shapes, colors and dimensions may vary slightly. By purchasing a kulô brand product, the purchaser is aware that the product is handmade and accepts that it may have slight imperfections, which do not hinder its use. However, we do our utmost to keep these imperfections to a minimum.
3. Conclusion of the contract
3.1 CACHALOT Atelier SNC assumes no responsibility for the fact that goods ordered cannot be delivered due to lack of available stocks, additional supplies or production.
3.2 Orders placed on www.kulo.ch will be accepted while stocks last. Orders are final upon confirmation of purchase. The sales contract is deemed to have been concluded when the order is validated.
3.3 Within 24 (twenty-four) hours of validation of the order, the buyer may ask CACHALOT Atelier SNC to modify or cancel the contract.
3.4 Under no circumstances may the purchaser modify or cancel an order when he has ordered items that have been manufactured and/or personalized at his request, or when the items ordered are already in the process of being delivered.
4. Reservation of ownership
4.1 CACHALOT Atelier SNC reserves ownership of the goods sold and delivered until payment of the purchase price.
5. Awards
5.1 Product prices are quoted in Swiss Francs (CHF) and include any discounts applicable on the day the order is placed.
5.2 Sales prices do not include delivery charges. Delivery costs are added to the sale price and are indicated in the order summary ("basket").
5.3 CACHALOT Atelier SNC reserves the right to modify prices freely and at any time. The price in force is that displayed at the time of purchase.
6. Resellers
6.1 The purchaser may only resell the goods purchased as part of his commercial activity if CACHALOT Atelier SNC has given its consent. A request must be made to hello@kulo.ch
6.2 Once the clauses have been discussed between CACHALOTAtelier SNC and the reseller, the latter undertakes to provide a detailed statement of sales on request and to remit the amount due to CACHALOT Atelier SNC. The reseller also undertakes to notify CACHALOT Atelier SNC of any price changes prior to their implementation.
7. Delivery costs
7.1 Postage and packing costs vary according to the amount of the order:

- < 100 chf : 9 chf
8. Delivery time
8.1 Delivery times :
- Orders placed on the site are sent every Wednesday by B Mail. The usual delivery time is 2 working days.
- Customized orders have a 15 working days delay from the reception of the payment.
8.2 The delivery times indicated in these General Terms and Conditions are given for information only. They are in no way binding. The purchaser is obliged to accept any delivery of products, even if the delivery is received after the time indicated.
9. Delivery
9.1 All orders can be collected from our workshop at Rue Jacques-Gachoud 3, 1700 Fribourg, by appointment.
9.2 Deliveries are made weekly on Wednesdays by B Mail. In the event of an urgent request, it is possible to write to us to obtain A Mail. Additional charges apply.
- Deliveries are made in Switzerland and Liechtenstein
- If requested, it is possible to deliver abroad. In this case, an offer is requested from the post office or another supplier for the delivery. If the buyer accepts the offer, he/she must pay the amount of the delivery offer.
9.3 When validating the order, the buyer is solely responsible for the accuracy of the contact information provided. CACHALOT Atelier SNC shall not be held liable in the event of an error in the customer's contact details, which could prevent delivery of the product.
9.4 If the delivery of a product is not made or is incomplete, the buyer has a maximum of one week (after the delivery date) in which to make a complaint. After this period, the complaint will not be accepted.
10. Transfer of risk
10.1 The transfer of risk - which includes the risk of loss as well as deterioration of the goods - passes to the purchaser upon receipt of the goods.
10.2 If the buyer does not take possession of the goods, the transfer of risk passes to the buyer when the goods are returned to CACHALOT Atelier SNC.
10.3 If the purchaser returns goods to CACHALOT Atelier SNC, the purchaser shall bear the risks until receipt of the goods by CACHALOT Atelier SNC.
11. Return or exchange policy
11.1 Items delivered by CACHALOT Atelier SNC may be returned within 14 days of receipt of delivery.
11.2 Returned items must be undamaged, complete and in their original packaging.
11.3 Customized or personalized items cannot be returned or exchanged under any circumstances.
11.4 Return shipping costs are at the buyer's expense.
12. Payment
12.1 Payment for goods can be made by credit card (Visa, Mastercard), ebanking prepayment, TWINT, Paypal or gift cards.
12.2 CACHALOT Atelier SNC may unilaterally impose a method of payment on the purchaser or refuse to enter into a contract with the purchaser.
12.3 Irrespective of the method of payment used, the purchaser understands and accepts that his payment may pass through a financial intermediary subject to legal obligations with regard to money laundering.
12.4 Any order may be subject to a request for a partial or total deposit. In this case, an order will be processed upon receipt of the requested deposit.
12.5 In the event of return of goods, the deposit paid by the purchaser will be reimbursed on request and after communication of the purchaser's bank details.
> Prepayment (e-banking)
12.6 In the event of prepayment, the purchaser must use the contact details given when confirming the order. The purchaser can make a bank transfer by indicating the IBAN: CH92 0900 0000 1548 2950 2 as well as his customer number under the reason for payment.
12.7 Items are reserved for a maximum of 5 days. After this period, if no payment has been received by CACHALOT Atelier SNC, they will be put back on sale.
> Payment by credit card(Mastercard and Visa)andTWINT
12.8 In case of payment by credit card or TWINT, the buyer will be debited at the time of the order. If an item is sold out or cancelled, CACHALOT Atelier SNC will refund the buyer's credit card or TWINT account.
12.9 CACHALOT Atelier SNC is not liable for any debit-related charges (not applicable to TWINT).
12.10 Credit cards may only be used for purchases made via the website. Orders placed by e-mail (customized or personalized orders) do not allow the use of the credit card. For TWINT, a QR code can be sent by e-mail for prepayment.
> Payment by Paypal
12.11 The purchaser may pay via his/her Paypal account. In this case, an order confirmation will be sent by e-mail to the buyer.
12.12 The use of Paypal is exclusively reserved for purchases made via the website. Orders placed by email (custom-made or personalized orders) do not allow the use of Paypal.
12.13 The buyer's Paypal account will be debited at the time of the order.
> Payment by gift cards
12.14 CACHALOT Atelier SNC accepts payment by gift cards, which are activated with a unique promotional code to be entered when ordering.
12.15 Gift cards are not eligible for any other promotional offers.
13. Product verification
13.1 If the product is damaged on receipt of the parcel, the purchaser must notify all claims within 48 hours of receipt of the parcel to the following e-mail address hello@kulo.ch. The money-back guarantee can only be applied if a request is made in writing, stating the reasons for the return and accompanied by photographic evidence.
13.2 In the absence of notice from the purchaser within the aforementioned period, the products are deemed to have been received in good condition, without defects or damage, and accepted as is, with the exception of non-apparent defects.

15. Applicable law and place of jurisdiction
15.1 The place of jurisdiction is the registered office of CACHALOT Atelier SNC, in Fribourg from May 1, 2020. In the event of a dispute, Swiss law shall apply.
