General terms and conditions of sale

1. Scope of application

1.1 This website is represented by the company CACHALOT Atelier SNC. These general conditions of sale are applicable to orders of products made by mail, mobile or internet with CACHALOT atelier SNC since April 01, 2022. By placing an order with CACHALOT atelier SNC, the buyer accepts the application of these General Conditions.

2. Control

2.1 Each item is designed and handmade by Camille Pasquier and Charlotte Pasquier.

2.2 Each product is unique, even if it comes from the same model. Indeed, during production, shapes, colours and dimensions may vary slightly. By purchasing a CACHALOT atelier SNC product, the buyer is aware that the product is handmade and accepts that it may have slight imperfections, which do not prevent its use. We make sure to limit them as much as possible.

3. Conclusion of the contract

3.1 CACHALOT shall not be liable for the fact that the goods ordered cannot be delivered due to lack of available stocks, additional supplies or production.

3.2 Orders made on will be accepted within the limits of available stocks. The order is final upon confirmation of purchase. The sales contract is deemed to have been concluded at the time of validation of the order. 

3.3 Within 24 (twenty-four) hours after the validation of the order, the buyer can ask CACHALOT atelier SNC to modify or cancel the contract.

3.4 Under no circumstances may the buyer change or cancel an order when he has ordered items that have been manufactured and/or personalised at his request or when the ordered items are already being delivered.

4. Reservation of ownership

4.1 CACHALOT Atelier SNC reserves the ownership of the goods sold and delivered until the purchase price has been paid.

5. Awards

5.1 The sales prices of the products are indicated in Swiss Francs (CHF) and include any discounts applicable on the day of the order.

5.2 The sales prices do not include delivery costs. The amount of the delivery costs is added to the sales price and is indicated in the order summary ("basket").

5.3 CACHALOT atelier SNC reserves the right to change prices freely and at any time. The price in force is the one displayed at the time of purchase.

6. Resellers

6.1 The purchaser may only resell the goods purchased in the context of his commercial activity if CACHALOT atelier SNC has given its consent. A request must be made to the address

6.2 Once the clauses have been discussed between CACHALOT atelier SNC and the reseller, the latter undertakes to provide on request a detailed statement of sales and to remit the amount due to him. He also undertakes to communicate all price changes before their application. 

7. Delivery charges

7.1 A contribution to the postage and packing costs varies according to the amount of the order:

  • > 100 chf : free
  • < 100 chf : 9 chf

8. Delivery time

8.1 Delivery times for (shipping) :

  • Orders placed on the site are sent every Thursday, by B Mail. The usual delay of the Post Office is 2 working days
  • Customized orders have a 15 working days delay from the reception of the payment.


8.2 The delivery times indicated in these General Terms and Conditions are given as an indication. They do not constitute a commitment. The buyer is obliged to accept any delivery of products, even if the delivery is received after the deadline indicated.

9. Delivery

9.1 For all orders, it is possible to come and pick them up in our workshop, at Rue Jacques-Gachoud 3, 1700 Fribourg, by appointment.

9.2 Deliveries are made weekly on Thursdays by the Post Office as B Mail. In case of urgent request, it is possible to write to us to obtain an A mail. Additional costs are applicable.

  • Deliveries are made in Switzerland and Liechtenstein
  • If requested, it is possible to deliver abroad. In this case, an offer is requested from the post office or another supplier for the delivery. If the buyer accepts the offer, he/she must pay the amount of the delivery offer.


9.3 When validating the order, the buyer is solely responsible for the accuracy of the information provided. In case of error in the customer's details, which could prevent the delivery of the product, CACHALOT atelier SNC will not be held responsible.

9.4 If the delivery of a product is not made or is incomplete, the buyer has a maximum of one week (after the delivery date) to manifest himself. After this period, the complaint will not be accepted.

10. Transfer of risk

10.1 The transfer of risk - which includes the risk of loss as well as deterioration of the goods - passes to the buyer at the time of receipt of the goods.

10.2 If the buyer does not take possession of the goods, the transfer of risk passes to the buyer when the goods are returned to CACHALOT atelier SNC.

10.3 If the purchaser returns goods to CACHALOT atelier SNC, the purchaser shall bear the risks until the goods are received by CACHALOT atelier SNC.

11. Return or exchange policy

11.1 Items delivered by CACHALOT atelier SNC can be returned within 14 days of receipt of delivery.

11.2 Returned items must be intact and complete, in their original packaging.

11.3 Items that are custom-made or personalised cannot be returned or exchanged under any circumstances.

11.4 The costs of returning the goods shall be borne by the buyer.

12. Payment

12.1 Payment for the goods can be made by credit card (Visa, Mastercard), ebanking, TWINT, Paypal or gift cards.

12.2 CACHALOT atelier SNC may unilaterally impose a method of payment on the buyer or refuse to conclude a contract with him.

12.3 Regardless of the method of payment used, the buyer understands and accepts that his payment may be made through a financial intermediary who is subject to the legal obligations regarding money laundering.

> Prepayment (e-banking)

12.4 In the case of prepayment, the buyer must use the contact details given during the order confirmation. The buyer can make a bank transfer by indicating the IBAN: CH92 0900 0000 1548 2950 2 as well as his customer number under the reason for payment

12.5 Items are reserved for a maximum of 5 days. After this period, if no payment has been received by CACHALOT atelier SNC, they will be put back on sale.

>Payment by credit card (Mastercard and Visa) and TWINT

12.6 In case of payment by credit card or TWINT, the buyer will be debited at the time of the order. If an item is sold out or cancelled, CACHALOT atelier SNC will refund the buyer to his card or TWINT account.

12.7 CACHALOT atelier SNC is in no way responsible for any charges related to a debit (not applicable to TWINT).

12.8 The use of the credit card is exclusively reserved for purchases made via the website. An order placed by email (customised or personalised orders) does not allow the use of the credit card. For TWINT, a QR code can be sent via email for pre-payment.

> Payment by Paypal

12.9 The buyer can pay CACHALOT atelier SNC through his Paypal account. In this case, an order confirmation will be sent by e-mail to the buyer.

12.10 The use of Paypal is exclusively reserved for purchases made via the website. An order placed by email (customised or personalised orders) does not allow the use of Paypal.

12.11 The buyer's Paypal account will be debited at the time of the order.

12.12 Any order may be subject to a request for a partial or total deposit. In this case, an order will be processed upon receipt of the requested deposit.

12.13 In the event of the return of goods, the deposit paid by the buyer will be reimbursed on request and after communication of his bank details.

> Payment by gift cards

12.14 CACHALOT atelier SNC accepts payment by gift cards which are to be activated with a unique promotional code to be entered when ordering

12.15 Gift cards are not eligible for any other promotional offers.

13. Product verification

13.1 If the product is damaged upon receipt of the package, the buyer shall notify any claim within 48 hours of receipt of the package to the email address The money back guarantee can only be applied if a request is made in writing, stating the reasons for the return and accompanied by photographic evidence. 

13.2 In the absence of notice from the Buyer within the aforementioned period, the products are deemed to have been received in good condition, without defects or damage, and accepted as is, with the exception of non-apparent defects.

15. Applicable law and place of jurisdiction

16.1 The place of jurisdiction shall be the registered office of CACHALOT atelier SNC, in Fribourg from 1 May 2020. In the event of a dispute, Swiss law shall apply.
